An intense standoff at Atlanta’s Four Seasons condominium ended Tuesday with the arrest of Jay Stevens Berger, a retired 70-year-old doctor.
Berger, a longtime eye specialist in the Atlanta area, stunned the community with actions that unfolded in a standoff with police involving gunfire.
The dramatic incident left both Berger and an Atlanta Police Department (APD) officer hospitalized with non-life-threatening injuries.

Around 4:30 p.m., Berger was taken into custody following a standoff during which he sprayed bullets from his 33rd-floor balcony, hurled furniture onto the streets below, and threw a gun from the balcony in an enraged outburst.
The events began around 10 a.m. when Berger reportedly confronted a hotel employee, leading police to respond, initially suspecting a mental health crisis.
At some point, Berger brandished a gun at an individual and then barricaded himself inside his room, prompting Atlanta Police Chief Darin Schierbaum to deploy SWAT teams to the scene.

As Berger began shooting through his door and out into the city from his balcony, authorities evacuated nearby floors and ordered a shelter-in-place for surrounding blocks.
Footage taken by witnesses in a nearby building captured Berger’s erratic rage.
He threw furniture and other random items off the balcony, nearly hitting bystanders filming the spectacle, as reported by WSB-TV.

Despite tossing one gun over the edge, Berger remained armed with at least three weapons—a pistol, a shotgun, and a rifle—each of which he fired during the standoff. Police later confirmed he also had several knives in his possession.
Atlanta Police and SWAT Response to Midtown Standoff

The intensity of the standoff peaked when Berger allegedly fired shots through his unit walls, door, and out from his balcony.
Berger, visibly wounded with a bloody cut across his face, was eventually apprehended and escorted into an ambulance.
Law enforcement officials responded with tactical measures to protect surrounding residents and deescalate the situation. Reports confirm that two APD officers returned fire when Berger aimed from his balcony.
Fortunately, the officers sustained only minor injuries, and Berger’s injuries were also reported as non-life-threatening.

He now faces aggravated assault charges, according to WSAV.
The unprecedented scene disrupted life in Midtown Atlanta and became a major topic across social media, making for an intense day at the usually calm luxury hotel.
In a statement, Four Seasons management emphasized that the incident took place in a private condo separate from the hotel area, which operates under different management.
This clarification was made to assure the public that hotel guests and areas were unaffected by the standoff.
Jay Berger’s Arrest: Standoff Ends with Peaceful Surrender

Following several hours of negotiation attempts, Berger raised his hands in surrender, signaling a peaceful end to the standoff.
SWAT officers entered his unit and arrested him without further resistance. Berger was transported to Grady Memorial Hospital, as was the injured APD officer, where both are reportedly in stable condition.

The GBI is investigating an officer-involved shooting in Atlanta, Georgia.
The Atlanta Police Department asked the GBI to conduct an independent investigation on October 29, 2024.
One man was shot and sustained non-life-threatening injuries. One officer was injured in this incident.
The preliminary information indicates that, at approximately 10:12 A.M., the Atlanta Police Department responded to a report of a subject pointing a gun at an employee at the Four Seasons Hotel.
The residential manager was contacted by a resident who advised a subject had thrown items into the hallway on the 33rd floor.
The manager went to the floor and was immediately confronted by a resident of the building, identified as Jay Berger, 70, who pointed a firearm at him.
The manager returned to the ground floor and called the police. Upon officers arriving, Berger barricaded himself inside his apartment.
SWAT was requested and responded to the scene. The subject began firing a weapon inside his apartment and into the hallway.
As rounds were fired through the walls at SWAT officers, one officer returned fire. One SWAT officer was injured during the incident (possibly by shrapnel).
The subject then proceeded onto the balcony of his apartment and began throwing items off the balcony.
At some point during the encounter, a SWAT sniper fired at the subject and struck him.
SWAT entered the subject’s apartment and took the subject into custody without further incident.
Berger was transported to an area hospital for treatment and will be taken to the Fulton County jail upon release from the hospital.
Once complete, the GBI case file will be turned over to the Fulton County District Attorney’s Office for review.
Additional charges against Berger are likely, as Atlanta police continue to piece together the details of what led to this unusual standoff in Midtown.

Atlanta residents and those who know Berger are struggling to make sense of the incident.
Friends and former colleagues describe Berger as a dedicated doctor who has mentored many in his field.
“He was always compassionate and gave back to the community,” said one former colleague. “No one expected something like this.”
While Berger’s record with the Georgia Composite Medical Board reveals a long history of practice dating back to 1984, he stopped practicing ophthalmology in Fulton County in 2021, as reported by 11Alive.
