Aaron Spencer, a father and decorated war veteran, now faces a second-degree enhanced murder charge after allegedly shooting a man he claims to have found late at night in a truck with his missing 14-year-old daughter.
Prosecuting Attorney Chuck Graham has filed the charge with an enhancement for the use of a firearm. Spencer’s plea arraignment is scheduled for December 2, 2024, at 9 a.m. before Judge Barbra Elmore.
The Incident: A Father’s Worst Nightmare
In the early hours of October 8, 2024, Aaron Spencer, 36, faced every parent’s deepest fear. At 1:12 a.m., Spencer contacted the Lonoke County Sheriff’s Office, reporting his daughter missing:
“Hey, my daughter, I can’t find her. She’s not in her room.”
As deputies mobilized, another call came in—this time, reporting a shooting. Spencer had located his daughter inside a truck with 67-year-old Michael Fosler, a man with a history of child sexual abuse. What followed was a confrontation between Spencer and Fosler that ended with Spencer allegedly shooting Fosler.
When authorities arrived at the scene, Fosler was pronounced dead, and Spencer was taken into custody. Initially charged with first-degree murder, Spencer was released but later re-arrested after further investigation and charged with second-degree murder, ABC 7 reported.
As of this publication, Aaron Spencer is not listed as an inmate in the Lonoke County Sheriff’s Office online jail records.
Legal Background: A Predator’s Troubling History
Michael Fosler's criminal past casts a dark shadow over this case. According to reports, Fosler had a no-contact order concerning Spencer's daughter after he had stalked and raped her earlier that summer.
Sheriff John Staley detailed Fosler’s history:
“We took a report of an inappropriate relationship and sexual misconduct. We forwarded it to Cabot detectives, and they worked the case.”
Fosler was arrested in July 2024, facing charges of rape and internet stalking, with later accusations of possessing child pornography. Despite these serious charges, he was released on bond—a decision that left Spencer's family in fear for their daughter’s safety.
Heather Spencer, the child’s mother, alarmed by the release, expressed concerns that Fosler might kill her daughter. As reported by Daily Mail, Heather said their daughter had been targeted, groomed and raped by Fosler, who was a boyfriend of a family member. Sheriff Staley confirmed the family's fears, stating:
“This guy that preyed upon their daughter was released on bond, and we stopped him that night and got him with her.”

“We have learned today that the Lonoke County Prosecuting Attorney has filed second-degree murder charges, with an enhancement seeking a higher sentence for the use of a firearm, against our client, Aaron Spencer. We are not just disappointed – we are outraged by this decision.
Aaron Spencer is a decorated war hero who protected his country and a loving father whose heroic actions protected his family. He is certainly not a criminal. He did what any father would do – and any trained combat veteran would do – to protect his child from a predator.
This predator repeatedly violated his child, and – undeterred by criminal charges and release on a low bond that pales in comparison to what was required of Aaron – kidnapped her in the dark of night to continue his assaults on her.
The systemic failures for decades that permitted this man to continue his abuses of women and children for years culminated in his facing a father who finally stopped him. No matter what the prosecuting attorney may do to Aaron, he was able to save his child and prevent this man’s continued acts of sexual violence against the most vulnerable among us – nothing could be more important than that.
While the prosecutor has made clear his intent to send Aaron to prison – even targeting his use of a legally owned firearm and in spite of his past experiences in combat – in this country, it is not the prosecutor who ultimately decides justice, it is the citizens.
We believe the citizens of this county and of this state will not allow this injustice, that this community will not allow a father protecting his child from a serial predator to be treated as a criminal.The repeated traumas Aaron’s family has endured over the last six months are unimaginable.
Sadly, the prosecutor’s decision perpetuates these horrors instead of protecting legitimate victims and punishing true criminal offenders. Instead of targeting this heroic father, the prosecutor should be working to figure out how the system failed to protect this innocent victim and instead resulted in her father having to do so.
We appreciate the support of so many who have voiced their outrage over the treatment Aaron, his child, and the rest of his family have suffered. We will stand up and fight for our right to protect ourselves and our children and will not be deterred by this unjust decision.
Please keep Aaron and his family in your prayers as they continue to heal from past events while now managing a criminal case. We look forward to Aaron’s day in court and to the end of this family’s nightmare.”
Even Sheriff Staley acknowledged the emotional complexity of the case, saying:
“I’m a daddy. In a similar situation, I can’t say I wouldn’t act the same way. But as law enforcement, we gather the facts so the prosecutor can determine whether it was justified or not.”
